Buy Distressed Property for Cheap with West Metro Realtor Travis Senenfelder

The idea of purchasing a home for substantially less than anticipated is something we can all agree upon. As the economy stagnates into a state of disrepair, we are all wondering when that much-needed break will come. Well, while some of us will have to wait until the recession’s suffocating grasp eases up, others can wine and dine Lady Luck today.

This past July marked the 17th consecutive month where foreclosures have exceeded 300,000 nationally. Never before have we seen such a network of real estate property available for not only significantly cheaper but accompanied by the lowest interest rates in 39 years. Banks are increasingly desperate to sell properties in jeopardy, as they are trepidatious about the welfare of their loans. What’s more is that the density of competition within the current market is almost non-existent. The majority of people interested in owning a home will not forego the troubles of negotiating through a pre-foreclosure, short sale or real estate owned (REO) offer. This opens up an incredible window of opportunity to invest in a property and see a more-than-generous turnout to fruition.

As an expert in property investment, I highly recommend the idea of buying a distressed home that is soon to be fresh on the market for several reasons. Consider purchasing a distressed property for a shadow of its previous price and, either, renting out your current home or simply switching your primary residence on the tax rolls. Through a short sale or REO purchased piece of realty, you could be looking at earning a cool $500,000 – tax free – in as little as two years.

With that being said, many transactions carry their share of risks and one must tread carefully before going ahead with such a lofty investment. As a recognized realtor within the Twin Cities’ West Metro, it is my duty and passion to ensure you make the best possible buy. Here is some personal insight I’ve gathered, based upon knowledge from past dealings and experiences:

Presenting the offer of a short sale, before a house’s impending foreclosure, generally carries the highest rate of success. Making an offer to purchase a property for less than the mortgage loan is an amicable way to score the best price and lessen the blow on the seller’s credit score.

A good place to start is researching the original sale price of the property to the owners. Troubled loan departments will typically take an offer equal to around 80% of the loan without a fight. If you are looking at a piece of property where the homeowners paid top dollar and received a 100% loan, you may have to offer anywhere between 20-30% of the mortgage to come out with a good deal. No matter the circumstances, always be sure to start with the lowest reasonable proposal -- making them come back to you with a counteroffer.

Next, get permission from the current borrowers to contact the bank’s short sale department. Find out the property’s exact foreclosure date, and with this knowledge in hand, issue a timely offer to the short sale department. Since this department does not communicate with the foreclosure people, odds are your short sale proposition will be accepted.

While these results aren’t typical and certainly not easy, turning a profit is more than plausible. The thought of earning $500,000 tax-free should be more than enough incentive to give it your best shot. However, in order to position yourself in the way of these earnings, you would need to buy something nicer than a $150,000 house on a suburban lot. For instance, say you purchase a house with the last transaction price being 700,000 and a $540,000 mortgage. If you purchase that for 35% off, you pay $351,000. When inflation skyrockets, sell it for $910,000, gain half a million dollars and go home after two years, tax-free. Food for thought.

[Note: This figure is derived from a husband-and-wife exclusion for the tax on the capital gain of a primary residence that has been occupied two of the five prior years.]

Travis Senenfelder Would Like to Welcome Back Mr. Favre

Hate it or love it, our grizzled hero is returning to the Land of 10,000 Championship Mistakes yet again. Donning that familiar purple number “4” jersey, I, of course, am talking about none other than Mr. Brett Favre.

No, the sky did not turn black and the moon blood red over the Midwest (namely Wisconsin). Instead, we received a modest Favre, accompanied by three fellow teammates, who stepped off a private plane and were subsequently ushered to Vikings’ camp headquarters. Apart from some heavily implied PR, no official word as to whether or not our senior sensation will in fact, be on this season’s roster, has been announced. As we all wait with bated breaths, we can only hope the 11-time Pro Bowler has decided to stave off old age for one (seemingly) last hurrah. Ankle surgery and a preseason training absence have left some of us with our doubts. For the majority, however, that skepticism was laid to rest the second he stepped down within the Purple perimeter.

As a die-hard fan, I can only hope the impending press conference will serve us all some much needed Viking vindication -- fingers crossed.

Homebuyer No-No's

No one ever said the homebuyer process was easy. Be that as it may, there are several valuable tips to consider before you take the big leap:

1.) Buy within your means. This is a big one. Purchasing your first home can be an exhilarating experience, however, you don’t want to go overboard amidst it all. It is important to factor in each and every monthly expense that occurs along your everyday routine. Compile a list of expenses such as vehicle costs, credit card payments, student loans, groceries, health insurance and so on. Add up these expenditures and subtract this total from your take-home pay. The remainder is a look at how much you can spend on your new home each month.

2.) Mortgage Qualification. Your idea of what you can afford and what the bank is ready to lend don’t always match up. A shaky income or poor credit can play a role in this, which is why it is vital to get pre-approved for a loan before placing an offer on a home. Otherwise, everyone’s time will be ultimately wasted should you sign a contract and later discover that the bank won’t lend you what you need. Furthermore, keep your credit score under close watch. Last minute credit alterations threaten to jeopardize your loan, which can result in the loss of several thousand dollars that you invested when you went under contract.

3.) Consider overlooked fees. There are several “hidden” costs that follow being a homeowner. Unlike before, you will now face the reality of property taxes, disaster insurance and any household repairs. If you are thinking about purchasing a condo, prepare to pay (mandatory) monthly maintenance fees that come with being a part of a homeowner’s association.

4.) Keep an open mind. Life isn’t perfect, and not all of us can afford an idealistic scenario. Many of us have to settle for less, and while that’s perfectly congruent with reality, it doesn’t have to be all that bad. Assess your current chapter in life, and decide whether you should save up by renting for a few more years or purchase as soon as possible. With that said, don’t be too inflexible to the point where you end up renting longer than you want to. Sometimes we just have to accept that busy street, outdated décor and necessary restoration as financial compromise. Chalk it up to giving the house character.

5.) Don’t sweat the small stuff. With respect to the previous tip, all houses aren’t without flaw. Wallpaper driving you crazy? Ignore the minor imperfections if the house’s size and location are what you have been looking for. Do-it-yourself home upgrades save you from expensive alternatives where the seller has already done the work for you. If you’re on a budget, look at homes whose vision has yet to be fully realized. Adding value to a home ensures a bump in equity and proves to be a worthwhile investment in the long run.

6.) Compromise with caution. While most first-time buyers have to compromise on projected ideals, it should be done with a grand perspective in mind. Don’t settle for a two bedroom when you plan on having kids. Compromise is natural; just don’t let it hinder your future plans.

7.) Explore every nook and cranny. I can’t stress this one enough. Check out every single aspect of the house you’ve got your eye on. Test the water to know exactly what you’re diving into.

8.) The momentousness of hiring an agent. Now this is where I come in handy. Working with both the buyer and seller, I negotiate the fairest deal possible with the buyer’s best interest in mind.

9.) It’s your future. We started off with a big one and we’ll end the same way. Picture the house you are considering to purchase in ten years. What about twenty?
- What kinds of neighborhood development plans are currently underway in Eden Prairie?
- What are the local zoning laws within Maple Grove?
- Is there undeveloped land nearby? If so, what will be eventually built near my Plymouth neighborhood?
- Has the home value of this Excelsior neighborhood been declining?

In reference to my article, “Stay On The Lake No Matter Your Income;” I detailed the reality of conducting a Lake Minnetonka lifestyle, without having to actually live on the lake. A Tax Credit Extension for Homebuyers

In early July of 2010, the National Association of Realtors (NAR) applauded congress for passing a bill to extend the homebuyer tax credit deadline. The bill, which was signed by the president on July 2nd, is designed to create a harmonious extension from its old deadline of April 30th to the new deadline on September 30, 2010.

The passage of H.R. 5623, the Homebuyer Assistance and Improvement Act, was originally passed in November of 2009 with the intention to simulate the U.S. housing market. The legislation functions by extending first-time homebuyers a tax credit up to $8000 until September 30, 2010, and expand the credit to grant $6500 credit to current homeowners purchasing an existing home between November 7th 2009 and September 30, 2010.

Buy Sell Lease (BSL Real Estate) of Excelsior, MN encourages potential homebuyers to take advantage of such credits. The Lake Minnetonka area has developed a reputation as one of the most sought after areas in the Midwest—which may be discouraging to first-time homebuyers, but the area greatly offers options within the brackets of this bill. Around Lake Minnetonka there are many older quaint neighborhoods with starter homes along the lake, and of course, backlots are less expensive than a home with lake frontage.

In regards to the qualifications for these credits, you might be surprised by how many homebuyers would qualify. Here’s the breakdown: Under the Extended Home Buyer Tax Credit, credit may only be awarded on homes purchased for up to $800,000. Single buyers with incomes up to $125,000 and married couples with incomes up to $225,000 may receive the maximum tax credit. However, if you exceed these limits you may still be eligible for the credit. And, if the buyer occupies the home for three or more years the tax credit does NOT need to be repaid.

An Update to the Landlord/Tenant Laws

Significant changes were made to landlord-tenant laws at the 2010 Minnesota legislative session this past May. The topics vary from late fees, to abandoned personal property, to federal foreclosure notice conformity. BSL Real Estate believes it’s important to have both well-informed clients and employees, and with that being said I’ve supplied a brief synopsis of some major changes.

All and all, there were eight landlord-tenant regulation topics that were subject to change during this last session and here they are (in a nutshell).

1. Cash Receipts: Management is now required to immediately provide a written receipt for payments made in cash.

2. Application-Screening Fees: In regards to applicant screening fees, here are the landlord’s MUST NOTS: A landlord may not collect or hold an applicant-screening fee without providing a written receipt for the fee upon request of the applicant. Nor may a landlord use cash, or deposit an applicant-screening fee until all prior applicants have either been screened or rejected, or offered the unit and declined to enter into a rental agreement. A landlord must also return the applicant fee if a prior applicant is offered the unit and agrees to enter into a rental agreement.

Now for the MUSTS: A landlord must disclose in writing, prior to taking the applicant screening fee, the criteria on which decision to rent will be based. Also, a landlord must notify the applicant within fourteen days of rejection, identifying the criteria the applicant failed to meet, and must return the application-screening fee if the applicant is rejected for any reason not listed in the required disclosure. Finally, a prospective tenant who provides materially false information on the application or omits material information requested is liable for damages, plus a civil penalty up to $500, civil court filing costs, and reasonable attorney fees.

3. Attorney Fees: For those residential leases that contain a provision providing that management may collect attorneys fees from the resident will now be construed to provide residents the right to collect attorney fees if successful in a legal action. Resident collection of attorney fees will be limited to the same type of action, the same circumstances, and to the same extent that management would be allowed to collect from the resident under the lease.

4. Abandoned Personal Property: This law has changed from 60 days to 28 days. This means management must now only retain the property for 28 days.

5. Late Fees: Fees for late payments are now up to 8% of the overdo rent payment.

6. Bad Faith Retention of Security: The specific additional bad faith penalty for management not returning or accounting for a security deposit increased to a maximum of $500.

7. Single Meter Buildings: There is now a penalty for violating conditions of separate utility billing in single-meter buildings.

8. Federal Foreclosure Notice Conformity: Under federal law, rental residents in foreclosed properties must be provided at least 90 days notice to vacate after the end of the redemption period rather than the two months required under state law. State law will conform to federal foreclosure law until the federal law sunsets on December 31, 2012 at which time the state law will returns to the two month notice requirement.

Remembering The Excelsior Amusement Park

It’s been over 35 years since the Excelsior Amusement Park decided to close their gates. Most of what was the amusement park is now site to a couple of restaurants and condominiums, but what remains are the local stories and few known artifacts that make this town an important piece of Minnesota’s history.

The Excelsior Amusement Park is important because it served as the primary amusement park to the Twin Cities prior to Valley Fair. It was a park inspired by Coney Island, and like Coney Island it too had rollercoaster that went by the name, The Cyclone. Along with the rollercoaster, Excelsior Amusement Park was home to a ferris wheel, bumper cars, boat rides, a fun house, and a carousel.

During the 1940’s, 50’s, and 60’s the ballroom was a popular hangout for people from all over the Twin Cities—especially teenagers. The ballroom was host to many popular musical acts, including Lawrence Welk, Tommy Dorsey, The Beach Boys, and the Rolling Stones. Excelsior is also home to the legendary “Mr. Jimmy,” who was believed to be the inspiration to the Rolling Stone’s You Can’t Always Get What You Want.

One of the remaining pieces of the old amusement park is the Allemarinda and James Wyer house, which from 1925 to 1974 housed the managers of the park. A few years after the park stopped operations in 1973, the National Register of Historical Places added the home to its prestigious list. Today, you can visit the home, which is known as The Christopher Bed and Breakfast.

Another important piece from the park is now located in nearby Shakopee, MN. In 1976, The Excelsior Amusement Park relocated its Philadelphia Toboggan carousel to Valley Fair, which is now the Twin Cities’ primary amusement park. The carousel was in service during the entire operation of the Excelsior Amusement Park, and still runs service to this day at Valley fair.

Working at BSL Real Estate in a historically rich area such as Excelsior is an amazing thing. Even though few mere artifacts are left from this specific piece of history, the stories and memories are engrained in this beautiful town’s DNA—and will be for generations to come.

Lake Home Tips

If “near the lake” just won’t cut it, consider these helpful tips before purchasing a lake home:

Determine an area. To start off the buying process, your first plan of action should be determining which city you would be spending the rest of your boating days. Try creating a list of your top potential cities, and then narrow down the search by looking at the different lakes they have to offer. For instance, if Maple Grove seems like a right fit, would you prefer Bass Lake or Weaver Lake? If Plymouth is where you want to start anew, are you going to reside by Medicine Lake or Gleason Lake? Etc.

Get to know the different lakes within that area. With so many lakes to choose from, finding the right one for you and your family may be difficult. Make sure to research each lake in order to compare and contrast. Then choose a lake that coincides with your income, family situation and personal hobbies.

Gain a comprehensive understanding of the lake. Since you’re purchasing a lake home, you’d better get acquainted with your soon-to-be neighbor. Take into account the different dynamics of the lake in question:
-Are there nearby amenities such as marinas and restaurants?
-What are the lake’s rules? Do they allow jet skis, racing boats?
-What about fishing regulations?
-Is my property along deep or shallow waters?
-If I want to increase my dock size or add an out building, are there any covenants or restrictions preventing this?

Check out different properties on the lake you choose. Realize property worth depends on several factors such as: full views, deep water, flat lake lots and the location itself.

Find the right price. Make sure you find a property that fits within your financial constraints and still incorporates your basic wants and needs. While purchasing the property may seem like your only monetary concern, it is only half of the equation. Each city and township’s cost of living is distinct. Sure you may be able to afford purchasing a home on Lake Minnetonka, but can you afford living among that community in ten years’ time?

Know the property inside and out. Always physically examine the property before you contemplate buying. Collect as much documentation regarding the property as humanly possible. Documents such as surveys, set backs, tax records, disclosures and plots are invaluable in helping you realize the full gravity of your purchase.

Having an office in downtown Excelsior sure has its perks. Aside from the gorgeous surroundings, I am always in the midst of exciting public events, great food and live performances.
